RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS

8. RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS
Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.

9. APPROVAL OF AMENDED DISTRICT PLAN FOR SERVICES TO ENGLISH LANGUAGE LEARNERS (ELLs)/LEP
Description
The Amended 2009-2011 District Plan for Services to English Language Learners (ELLs)/LEP is being presented for approval.

Recommendation
That the School Board of Sarasota County approve the Amended 2009-2011 District Plan for Services to English Language Learners (ELLs)/LEP.

10. RESOLUTION FOR SURPLUS AND SPOT SURVEY ACTIONS FOR THE OLD TRIAD FACILITY
Description

In August of 2010 the Triad program moved from the district's four-acre site at 4409 Sawyer Road into remodeled spaces at the old CYESIS Facility.  Since then the district determined that the prior site has no further educational purpose and processed a Request for Proposals to solicit interest in leasing or purchasing the site.  There is now a contract to sell the site.



Recommendation
That the School Board adopt the attached Resolution declaring that the property at 4409 Sawyer Road is no longer necessary for educational purposes and directing staff to submit a Plant Survey amendment recommending disposal of the site.

11. APPROVAL OF CONTRACT TO SELL THE OLD TRIAD PARCEL
Description

AGREEMENTS/CONTRACTS

12. APPROVAL OF THE CONTRACT BETWEEN PROFESSIONAL DEVELOPMENT FOR ACHIEVEMENT, INC. AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description
Professional Development for Achievement, Inc. (PDA, Inc.) will provide writing professional development training for ninth and tenth grade English/Reading teachers at Sarasota County High Schools.  This contract in the amount of $20,000 requires School Board approval since PDA, Inc. has additional contracts which exceed the $50,000 limit.  This contract is funded through the Education Foundation.


Recommendation
That the contract between Professional Development for Achievement, Inc. and the School Board of Sarasota County, Florida, be approved.

13. AGREEMENT BETWEEN THE RED CROSS AND THE SARASOTA SCHOOL DISTRICT
Description
This is the Shelter agreement between the Red Cross and the Sarasota School District for the use of the School Board locations identified as emergency shelters during a disaster.  The agreement outlines each organizations responsibilities and roles, provides for additional personnel to assist along with School District staff.  It also provides reimbursement associated with damage to the facility, and reimbursement to the District for funds to pay for custodial and food service personnel.

Recommendation
That the School Board approve the agreement between the Red Cross and the Sarasota School District.

EXPULSIONS

14. APPROVAL OF EXPULSION CASE NO. 11-271
Description
School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative school.

Recommendation
That Expulsion Case No. 11-271, be held in abeyance per School Board Policy 5.34.

15. APPROVAL OF EXPULSION CASE NO. 11-449
Description

The student listed in Expulsion Case No. 11-449, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 27, 2011, the student listed in Expulsion Case No. 11-449, violated School Board Policy 5.34(1)(d), Distribution of Counterfeit Money.  It is the recommendation of the Superintendent, that the student be expelled from the Sarasota County Schools until August 1, 2012.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-449, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year, the 2012 summer session until August 1 of the 2012-2013 academic year.

16. APPROVAL OF EXPULSION CASE NO. 12-039
Description
On September 12, 2011, the student listed in Expulsion Case No. 12-039, violated School Board Policy 5.321, Possession.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 30, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case 12-039, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

Description

On September 23, 2011, the student listed in Expulsion Case No. 12-043, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 15, 2012.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-043, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

Description
On September 27, 2011, the student listed in Expulsion Case No. 12-064, violated School Board Policy 5.34(1)(d), Vandalism.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 6, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-064, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

CONSTRUCTION

20. APPROVAL OF NON-EXCLUSIVE UTILITY EASEMENT AT BOOKER HIGH SCHOOL BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND FLORIDA POWER AND LIGHT COMPANY
Description
This easement will assign an easement for the construction, operation and maintenance of underground electric utility facilities (including wires, cables, conduits, and appurtenant equipment) to be installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as the size of and remove such facilities or any of them within an easement ten (10) feet in width.  This easement has been approved by the School Board attorney.

Recommendation
That the Non-Exclusive Utility Easement at Booker High School between the School Board of Sarasota County, Florida, and Florida Power and Light Company, be approved as presented.

21. APPROVAL OF THE DELETION OF BUILDINGS NO. 1, 2, 3, 4, 5, 14, 15, 16, 23, 25, 80 AND PORTABLES NO. 99-106B, 99-106C, 99-481 AND 99-577 AT SARASOTA COUNTY TECHNICAL INSTITUTE (SCTI)
Description
The specified buildings are one-story buildings and portables that are in the path of construction for Phase III at SCTI.  The demolition value of these buildings has been proven by the Castaldi Formula calculation.  Funds for this demolition are available in the capital projects account.

Recommendation
That the deletion of Buildings No. 1, 2, 3, 4, 5, 14, 15, 16, 23, 25, 80 and Portables No. 99-106B, 99-106C, 99-481 and  99-577 at Sarasota County Technical Institute (SCTI) from the F.I.S.H. inventory for demolition, be approved as presented.

22. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $883,410.98 in gross contract dollars.

Included in these change orders are $535,328.74 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $504,885.60 result a net of $30,443.14 in sales tax savings.



Recommendation
That the Construction Service's Change Order(s) be approved and/or ratified as presented.

23. APPROVAL OF THIRD AMENDMENT TO THE HP FINANCIAL SERVICES AGREEMENT
Description
This amendment reflects the reduced lease payments due to favorable price adjustments.
